Official Rules

1. Overview: On March 11, 2023 (the “Event Date”), Lowe’s Home Centers, LLC, 1000 Lowe’s Blvd., Mooresville, NC, 28117 (“Sponsor”) will sponsor the Lowe’s Bucket-Ball Challenge Promotion (“Promotion”) which consists of separate tournaments (each a “Tournament”) to be conducted at and administered by participating Lowe’s store locations across the United States (each a “Participating Store”), subject to these common Official Rules (the “Rules”). Each Participating Store will conduct three (3) Tournaments in store on the Event Date. Each Tournament consists of a series of games between two Players (as defined in Rule 3, below) who compete to see who can more quickly toss their balls buckets placed at a distance from them (the “Game”). Details for the Game are further explained in Rule 4, below. If a Player wins their Game, they will advance in their particular Tournament, with one Player eventually winning the final Game of the Tournament. Each Tournament is scheduled to take approximately one (1) hour in duration, with the first Tournament in each Participating Store starting at approximately10:00 a.m., the second Tournament starting at approximately 11:00 a.m., and the third Tournament starting at approximately 12:00 p.m. All times are local times for the Participating Store. Actual times may vary depending on the time it takes to complete each Game/Tournament.

2. Eligibility: The Promotion is open to legal residents of the fifty (50) United States and District of Columbia who are thirteen (13) years of age or older at time of entry. For any potential participant who is not the legal age of majority in his/her jurisdiction (which is 18 in all states, except 19 in Alabama and Nebraska), you must have permission of your parent or legal guardian to enter and accept prize. Employees, directors, officers, contractors and agents of Sponsor, and its parent and affiliated companies, dealers, advertising and promotional agencies, and suppliers (“Promotion Entities”), as well as the members of each of their immediate families (defined as spouse, parents, children, sibling; whether natural, adopted, step, or in-law) and persons residing in the same household as such individuals (whether related or not) are not eligible to participate. Void where prohibited or restricted by law. Participation in the Promotion constitutes participant’s full and unconditional agreement to these Terms and Conditions.

3. How to Become a Player: To become a Player in a Participating Store’s Tournament, you may either enroll online in advance of the Event Date in one of the ten (10) “Advance Spots” that are available for each Tournament at each Participating Store, or you may enroll on the day of the Promotion in one of the remaining “Tournament Day Spots” that are available for that Participating Store on the Event Date. There will be at least ten (10) Tournament Day Spots available for each Tournament at each Participating Store. Limit one enrollment in one Tournament per person or email address, regardless of method of enrollment and regardless of Participating Store. If the Advance Spots are filled for a particular Tournament in a Participating Store, eligible participants are welcome to try to enroll in a different Tournament for that Participating Store or look for another Participating Store that still has Advance Spots available, or they can attend a Participating Store on the day of the Promotion and try to obtain a Tournament Day Spot for one of the Tournaments.


a. Advance Spot Enrollment: To enroll for an Advance Spot for a Tournament at a Participating Store, eligible participants with a valid myLowe’s account must log into [https://www.lowes.com/events/register/lowes-bucket-ball-challenge] (“Enrollment Site”) and complete the enrollment form for a Tournament, while Advance Spots remain available. Advance Spot Enrollment will begin at 3:00 a.m. ET on February 1, 2023 and will end on the earlier of when the ten (10) Advance Spot Enrollments for a Tournament have been received, or at 11:59 p.m. ET on March 10, 2023. If you do not have a valid myLowe’s account, you can create one for free at Lowes.com, and then complete the enrollment for an Advance Spot in a Tournament at the Enrollment Site, while Advance Spots remain available. You will be notified online if you have been assigned to be a Player for a Tournament, and the date/time/location of your Tournament.


b. Tournament Day Spots Enrollment: To enroll for a Tournament Day Spot, eligible participants must sign up by providing their first and last name on the registration sheet for a Tournament on the Event Day at a Participating Store, while spots remain available. Tournament Day Spots are available on a first come, first served basis. Once enrolled by either method, an eligible participant shall be referred to herein as a “Player.” When it is time for a Tournament to begin, an announcement will be made on the Participating Store’s loud speaker and all Players for that Tournament must check in at the Tournament location within the store within five minutes of the announcement or they may be disqualified and an alternate Player may be selected to fill their spot. Failure to appear at the Game location at the Participating Store within five minutes instore announcement may result in disqualification and selection of an alternate Player. Each Participating Store will designate an Event Captain to run the Tournament and the Event Captain’s decisions in all matters regarding enrollment, disqualification, Game Play, Tournament decisions, interpretation of the Rules (including the ability to add, change or waive any Rules as necessary to improve the flow of the Tournament or any individual Game) shall be final and binding. Attempts to enroll more than the stated limit per person or email address, or enrollments that are incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late, misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from all Tournaments in Sponsor’s or Event Captain’s sole and absolute discretion. For Advance Spot enrollments, participants are prohibited from using more than one (1) myLowe’s account or multiple identities. If it is found or suspected that a participant is using or has used more than one myLowe’s account or multiple identities to participate in multiple Tournaments, then that participant, in Sponsor’s or Event Captain’s sole discretion, may be disqualified and not be eligible to win a prize.

Sponsor or Event Captain reserve the right to disqualify any person who tampers with the enrollment process or otherwise fails to conduct themselves in a sportsmanlike manner, as determined solely by Sponsor or Event Captain. Subsequent attempts made by the same individual to submit multiple enrollments by using multiple or false contact information, accounts or otherwise may result in the entrant being disqualified. Enrollments generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Enrollments submitted by participants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Enrollment materials become the property of Sponsor and will not be returned.


4. Game Play: Each Game is played with two Players (randomly matched by Event Captain) who stand opposite of each other across an approximate eight (8) foot space (the “Field”). On each side of the Field there will be a triangle formation of 6 buckets (the Event Captain will have the option to reduce the number of buckets to 3 if the rate of Game play is going slow and risks the Tournament not being completed in its allotted hour time frame). Each Player will be given two (2) balls, and will have to stand and keep all body parts behind a marked line on their side of the Game Space when tossing their balls. When it is a Player’s turn, the Player will have one attempt to throw each of their two balls across the Field into a bucket.
If a ball lands in a bucket, that bucket will be removed. (If the first ball lands in a bucket, that bucket will be removed before the second ball is thrown). If no balls land in any buckets, all buckets will remain. Once a Player has tossed both of their balls, it is the other Player’s turn. The first Player who eliminates all of the buckets across the Field from where they are standing is the winner of that Game and will move on in the Tournament (unless it is the final Game of the Tournament). Their opponent will be done in the Tournament. The Player to go first in any Game is determined by one game of rock, paper, scissors (“RPS”). RPS will work as follows:


The Players will stand with their backs to each other and the Event Captain will count out loud “1, 2, 3, throw.” When the Event Captain says “throw” each Player must immediately throw the hand signal for rock, paper or scissors. If a Player is not familiar with RPS and does not know the hand signals, the Event Captain will show them prior to starting the RPS game. Rock will beat scissors. Paper will beat rock. Scissors will beat paper. If both parties throw the same object, they will play another round of RPS again until one Player beats the other at RPS. The outcome of RPS is significant because if the Player to go first in the Game eliminates their buckets first, the second Player does not get the opportunity to take another turn.


5. Tournament Play: The winner of each Game in a Tournament (other than the last Game of that Tournament) moves on to the next round in the Tournament and plays a new Player based on a Tournament bracket created by Sponsor. When the last Game of each Tournament is played, the winner of that Game is the First Place winner of that Tournament and will be awarded a First Prize, and their opponent in the last Game of that Tournament will be the Runner Up and will be awarded a Second Prize.


6. Prizes: The following prizes are available to be awarded by each Participating Store for each of their three Tournaments, for a total prize value per Participating Store of $180.00. This is a skill contest determined by one’s ability to more accurately toss balls into a bucket, but the odds of being selected to participate depend on the number potential participants and the order in which they present themselves to participate, along with those participant’s luck in the RPS game to determine order of play.


First Prize: A $50 Lowe’s Gift card (3 per Participating Store)
Second Prize: A $10 Lowe’s Gift card (3 per Participating Store)


7. Miscellaneous Prize Details: The potential winner of each prize is subject to verification of eligibility and compliance with these Rules. Each potential winner (or their parent or legal guardian if such winner is a minor) may be required to present a driver’s license or state identification card to confirm address and age, or may be required to sign and return a Declaration of Eligibility and Liability/Publicity Release (except where prohibited), and/or any other requested documents to claim prize, or the respective prize may be forfeited in its entirety in Sponsor’s sole and absolute discretion. Upon confirmation of eligibility and compliance with these Rules, the Event Captain will award the Lowe’s Gift Card. If potential winner is disqualified, found to be ineligible or not in compliance with these Official Rules, or if potential winner declines to accept prize, the prize will be forfeited. Gift Cards are subject to terms stated on the Gift Card and as otherwise imposed by the issuer. Prizes may not be substituted and no cash redemptions are allowed. All taxes on prizes are the responsibility of the winner. All prizes claimed by the potential winner within one hour of the conclusion of the Tournament will be awarded. If a potential winner fails to claim the prize within one hour of the conclusion of the Tournament, the prize may be forfeited.


8. Release and Limitation of Liability: As a condition of participating in the Promotion, Players agree (and agree to confirm in writing, if requested) to release and hold harmless Lowe’s, the Promotion Entities, each of their parent company, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising and marketing agencies, promotions and public relations agencies, production and fulfillment companies, website providers, and any other entities or individuals involved in the creation, execution or administration of the Promotion, along with any of their respective officers, directors, shareholders, employees, representatives, designees, contractors, and agents (“Released Parties”), and such Players further agree that such Released Parties shall have no liability whatsoever for and against any liability for (a) lost, late, incomplete, stolen, illegible, damaged, mutilated, misplaced, tampered with, deleted, destroyed, misdirected enrollments or failures to maintain order in the line for Tournament Day Spot enrollments; (b) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (c) garbled, corrupt or jumbled transmissions, service provider/network accessibility, availability or traffic congestion; (d) any technical, mechanical, printing or typographical or other error; (e) the incorrect or inaccurate capture of enrollment information or the failure to capture, or loss of, any such information; (f) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to a Promotion; and/or (g) any injuries, losses or damages of any kind to person(s) including, without limitation, death, or injury to persons or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Promotion or any Promotion-related activities.

By enrolling the Promotion, each participant agrees: (i) to be bound by these Official Rules; (ii) to waive any rights to claim ambiguity with respect to these Rules; (iii) to waive all of his/her rights to bring any claim, action or proceeding against any of the Released Parties in connection with a Promotion; and (iii) to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Promotion, including any Promotionrelated activity or element thereof, and the participant’s enrollment, participation or inability to participate in a Promotion; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by such participant or any other participant.


9. Disputes: ANY MATTERS OR DISPUTES RELATING TO THIS PROMOTION SHALL BE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NORTH CAROLINA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN THE MECKLENBURG COUNTY, NORTH CAROLINA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NORTH CAROLINA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN CHARLOTTE, NORTH CAROLINA. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT AND/OR RELEASED PARTIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF PROMOTION ENTRY PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

10. Publicity Rights: By participating in the Promotion, each participant agrees to allow Sponsor, Participating Stores and their designees to film, photograph and otherwise record the Games and Tournament (“Footage”) and the perpetual right to use such Footage as well as the participant’s name, address (city and state), biographical information, likeness, picture, voice and other information (as seen in the Footage or otherwise) for promotion, trade, commercial, advertising and publicity purposes in all media worldwide including, but not limited to, on television and the Internet, without notice, review or approval and without additional compensation, except where prohibited by law.


11. Miscellaneous: If, for any reason, the Promotion overall, or any Game or Tournament at any Participating Store, is not capable of running as planned, Sponsor or the Store Captain at such Participating Store reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend such Promotion, Game or Tournament, as they see fit. In such case, Sponsor or the Store Captain, as the case may be, may determine an alternate manner to proceed with the Promotion, Game or Tournament, including the selection of winners in a manner it deems fair and reasonable, including the selection of winners from among eligible enrollments received prior to such cancellation, termination, modification or suspension. In no event will more prizes be awarded than are stated in these Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more potential winners than are stated in these Rules, a random drawing among the claimants will be held to determine the winners.


WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS
PROMOTION, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.


Any attempted form of participation in a Promotion other than as described herein is void. Lowe’s reserves the right to disqualify any entrant found or suspected, in their sole and absolute discretion, to be tampering with the operation of a Promotion; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of a Promotion. Any attempted form of participation in a Promotion other than as in these Official Rules is void. If any provision of these Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Rules valid and enforceable. The invalidity or unenforceability of any provision of these Rules or the prize documents will not affect the validity or enforceability of any other provision. No entrant shall have the right to modify or amend these Rules. Lowe’s failure to enforce any term of these Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. All enrollments and/or materials submitted become the property of Sponsor and will not be returned. In the event of any conflict between these Rules and any details contained in any promotional materials relating to the Promotion, these Rules shall prevail.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR
UNDERMINE THE LEGITIMATE OPERATION OF A PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE LOWE’S RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Winners’ List: For the name of the winners from a particular Participating Store, please send a self-addressed stamped business envelope to:

Winners’ List requests must be received no later than April 11, 2023 and must state the address for the Participating Store for which they are requesting the Winner List as indicated or they will not be honored.
